DWP PIP Back Payment Review – Personal Independence Payments Details!

After the Supreme Court ruling, the Department of Work and Pensions is reviewing the Personal Independence Payments back payments claims, which backdated to April 2016. PIP claimants can receive a payout worth £5000 as the back payment which can change their life.

DWP PIP Back Payment Review

The highest court in the UK ruled that DWP had incorrectly assessed the PIP assessment criteria, which led to many PIP claimants being due with backdate payments. In July 2019, the Upper Tribunal changed the DWP PIP assessment criteria for the Daily Living component of the PIP as per the Supreme Court Ruling. 

After altering the assessment criteria, the DWP has released new figures of claimants who may be entitled to receive the due back pay dating back to April 2026. The DWP is reviewing the claims for such PIP claimants and indicated that more than 320,000 reviews are being carried out to check whether they are entitled to the back payments. 

The DWP has revealed that they have already received 219,080 cases and released a £142 million payout; they estimate that they may review around 632,286 PIP claims for this year’s correction exercise. With the ongoing review, UK-eligible citizens who receive PIP benefits can receive the due underpayment termed as back pay.

Change in the PIP Daily Living Component assessment criteria

As per the Supreme Court ruling, the assessment criteria for PIP daily living component is focussed more on the individual ability to perform the activities rather than his need of social support. 

So, the Upper Tribunal changed the definition of social support activity nine for the PIP Daily Living Component. The points added with activity nine, socializing and being around other people are the assessment should be carried out based on the person’s ability to interact face-to-face with people and prompting when they need social support. 

The new rule says that when people need an explanation, reminder, or encouragement from a trained professional for assistance in socializing they will be entitled to social support and gain daily living component points. The changes may bring additional people under the daily living component of the PIP, leading to additional PIP payments. 

DWP PIP Back Payment Amount

The PIP underpayment is due according to the changed PIP assessment criteria and the years of not receiving the payment. The amount of PIP back payment may vary from person to person according to their due payment over the years. 

According to reports, last year, the average payment for the reviewed cases of backdated payment was around £52,00. The claimants have reported receiving back payments ranging from £3000 to £1000 depending on their eligibility. 

This year, the PIP claimants under the review can expect a payout of up to £5000 depending on their underpayment due to the change in the PIP assessment criteria on social support. The people who may gain more points due to the change in assessment can expect a call or letter from the DWP related to their back payment. 

Who will be entitled to DWP PIP back payment?

Well, the PIP claimants can check if they are eligible for the DWP PIP back payment based on the below criteria:

  • You receive PIP benefits and are assessed under the number nine activity, socializing with people.
  • You have missed the daily living component payment or been awarded with the standard and now with the change in assessment criteria, you may be entitled to receive the enhanced rate payout. 
  • You score an additional 2 points under the current 9(b) score as they may require prompting.

As we have mentioned earlier, the DWP may send the letter or call the people entitled to backdated payment. The claimants who have received the backdated payments claim the DWP called them and asked them a few questions about their plans and special support requirements.

Which claims will not be reviewed under the PIP back payment? 

According to the DWP reports, there are certain claims, that DWP will not be reviewing for the back payments, such as:

  • The claimants with payout based on the enhanced rate of Daily living component and receiving the payment continuously since 6 April 2016.
  • The Upper Tribunal has decided that PIP claims should be reviewed from 6 April 2016. 
  • The claims received the PIP before April 6 2026 as the Tribunal decided to backdate payment from 6 April 2016.

How to claim the DWP PIP back payment?

Though DWP is reviewing the PIP cases to check the claimants who are entitled to backdated payment since 6 April 2016 and send them a letter or make a call, still, if you believe you are eligible for the payment and the DWP has not contacted you, you may contact the DWP to claim your DWP PIP back payment. 

Such claimants can call for Mandatory Reconsideration (MR) for the due PIP back payments by contacting the authority where they applied for the benefit.  The claimants must ask for the MR before the appeal is made regarding the benefit to the HMCTs (His Majesty’s Courts and Tribunals Service). 

The claimants who are entitled to receive the PIP back payments should also contact the HMRC after receiving the payment to inform the agency of the error made on working and claiming tax credits during the period you may be entitled to the PIP payments.

The claimants may receive extra payment with their back payment combined with a Working tax credit around a payout of £5,500 for the payment that should have been made earlier. 

The UK citizens who have been receiving or received the payments during the review period decided by the Tribunal may be entitled to the backdated payment, so check if you are entitled to the payment or not to receive your due payout from DWP.
